General Terms and Conditions (GTC) for the rental of the holiday apartment

 

1. Conclusion of Contract

 

By booking (via the website, in writing, or by email), the guest makes a binding offer to conclude a short-term rental agreement. This initially constitutes a reservation. The contract is only concluded upon receipt of the landlord's written or electronic (email) booking confirmation.

 

2. Payment

 

Upon receipt of the booking confirmation, payment of 100% of the rental price is due within the payment period specified in the booking confirmation. Depending on how far in the future the rental period lies, the payment period may be longer or shorter.

 

3. Services and Prices

 

The prices agreed upon in the contract include additional costs (electricity, water, heating), taxes, and final cleaning, unless otherwise stated. Bed linen and towels are included. Only those services stated in the apartment description on the website are deemed to be agreed upon. Deviations from this must be made in writing.

 

4. Withdrawal / Cancellation

 

The guest may withdraw from the contract at any time. The receipt of the cancellation notice by the landlord is decisive. The following cancellation fees apply:

 

- up to 30 days before arrival: 0% of the rental price (full refund)

-up to 15 days before arrival: 50% of the rental price (partial refund)

- thereafter or in case of no-show: 100% of the rental price (no refund)

 

The guest reserves the right to prove that the landlord has suffered no or significantly less damage.

  

5. Cancellation of Contract in Case of Non-Payment

 

After booking, you will receive a booking confirmation from us stating the deadline for payment of the rental price (receipt of payment by us). In case of late payment, the short-term rental agreement automatically expires and the booking/reservation is forfeited. No further written form is required. In this case, the landlord is immediately entitled to offer the rental property to someone else or to rent it out.

  

6. Guest Obligations

 

The holiday apartment may only be occupied by the number of people stated in the booking. Pets are not allowed. The guest undertakes to treat the apartment with care and to report any damage immediately. The house rules can be viewed in the footer of the website and are an integral part of the short-term rental agreement.

 

7. Liability

 

The booking party is liable for all damage caused by them or their fellow guests to the rental property, inventory, or shared facilities. The landlord is not liable for the guest's valuables. In the event of failures or disruptions to the water, electricity, internet, or satellite TV that are beyond the landlord's control, there is no entitlement to a rent reduction.

 

8. Arrival and Departure

 

The vacation apartment is available from 3 p.m. on the day of arrival. The apartment must be vacated and swept clean by 11 a.m. on the day of departure.

 

9. Bookings for Third Parties

 

Bookings for third parties are only permitted after prior agreement with the landlord. Written confirmation from the landlord is required before the contract is concluded. Without such confirmation, we reserve the right to refuse check-in. A refund of the rental price is excluded in such a case because the person making the booking has not arrived.

 

Example: Alex Fröhlich books for himself and two other guests. However, Alex Fröhlich does not arrive, but only two or three unannounced guests. This constitutes a booking for a third party.

 

10. Number of Guests

 

The maximum number of guests is stated in the booking confirmation. Additional guests can only be accommodated after written confirmation from the landlord. There will be a charge for each additional person, which we will confirm to you in writing and which must be borne by the contracting party.

 

11. Final Provisions

 

Changes or additions to this contract must be made in writing. Should individual provisions be invalid, the validity of the remaining provisions shall remain unaffected.


The place of jurisdiction, to the extent permitted by law, is Wildau, 15745 - Germany.
